Growth Hub Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of RealBusiness.ai’s Growth Hub platform, including our website, AI-powered business tools, courses, and related services (collectively, the “Services”). By registering for an account, enrolling in a course, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not access or use the Services.

1. Eligibility

You must be at least eighteen (18) years old and have the legal capacity to enter into binding contracts to use the Services. By creating an account, you represent and warrant that you meet these eligibility requirements.

2. Account Registration and Security

You agree to provide accurate, current, and complete information when creating an account and to promptly update any information that changes. You are solely responsible for safeguarding your login credentials and all activity that occurs under your account. Notify us immediately of any unauthorized access.

3. License Grant and Permitted Use

Subject to these Terms, RealBusiness.ai grants you a limited, non-exclusive, non-transferable license to access and use the Services solely for your internal business purposes. You may not copy, modify, distribute, sell, or create derivative works from the Services, nor attempt to reverse engineer or bypass security measures.

4. AI-Generated Outputs

The Services include AI-generated insights, reports, and recommendations (“AI Outputs”). AI Outputs are provided “as-is” and may contain errors or omissions. You acknowledge that AI Outputs do not constitute professional advice. You are solely responsible for evaluating the accuracy, completeness, and suitability of AI Outputs for your purposes. RealBusiness.ai disclaims all liability arising from your reliance on AI Outputs.

5. User Content and Data Rights

You retain ownership of all content and data you upload to the Services (“User Content”). By uploading User Content, you grant RealBusiness.ai a worldwide, royalty-free, transferable license to use, host, store, reproduce, and analyze User Content solely to provide, maintain, and improve the Services.

You represent and warrant that your User Content does not violate any third-party rights or applicable laws.

6. Intellectual Property

All rights, title, and interest in and to the Services (excluding User Content) remain with RealBusiness.ai and its licensors. The Services and all associated intellectual property are protected by copyright, trademark, and other laws. You may not use RealBusiness.ai’s trademarks, logos, or branding without prior written consent.

7. Fees, Payment, and Refunds

Certain features and courses require payment of fees as displayed at the time of purchase. All fees are non-refundable except as required by law or expressly stated otherwise. Subscription services automatically renew until canceled. You may cancel at any time; cancellation takes effect at the end of your current billing period.

8. Acceptable Use

You agree not to use the Services to:

Violate any law, regulation, or third-party right;
Upload malicious code or infringing content;
Attempt unauthorized access to RealBusiness.ai or third-party systems;
Harass, defraud, or defame any person;
Interfere with the security or performance of the Services.

9. Third-Party Services

The Services may integrate with or link to third-party tools. Your use of such tools is subject to the third party’s terms and policies. RealBusiness.ai is not responsible for third-party content, services, or practices.

10. Termination and Suspension

We may suspend or terminate your access immediately if you breach these Terms, engage in prohibited conduct, or if required by law. Upon termination, your license to use the Services ends, but Sections 4, 5, 6, 10, 11, 12, and 13 will survive.

11. Disclaimers and Warranty Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. REALBUSINESS.AI DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALBUSINESS.AI’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO REALBUSINESS.AI IN THE SIX (6) MONTHS PRIOR TO THE CLAIM. IN NO EVENT SHALL REALBUSINESS.AI BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Indemnification

You agree to indemnify, defend, and hold harmless RealBusiness.ai and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, or expenses arising from your breach of these Terms, your User Content, or your use of the Services.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association in Wilmington, Delaware, pursuant to its Commercial Arbitration Rules, except for small claims disputes which may be brought in small claims court.

15. Changes to Terms

We may update these Terms from time to time. We will provide notice at least fifteen (15) days before changes take effect via email or in-app notification. Continued use of the Services after changes constitutes acceptance.

16. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from events beyond its reasonable control, including natural disasters, acts of government, or cyberattacks.

17. Entire Agreement

These Terms, together with any additional terms referenced herein (including the Privacy Policy), constitute the entire agreement between you and RealBusiness.ai regarding the Services.
